Terms of Service

These Terms govern your use of Fairy AI (the "Service") and set out the rights, obligations, and responsibilities of both the Service and its users.

Article 1 (Purpose)

These Terms exist to define the rights, obligations, responsibilities, and other necessary matters between the Service and users in connection with the Fairy AI Chrome extension and its associated website (together, the "Service").

Article 2 (Definitions)

• Service: The Chrome extension and companion website that provide conversation with, and image-recognition interactions with, an AI character (a "fairy") that lives on top of web pages.
• User: Any person who uses the Service under these Terms.
• Soul stones: A virtual currency used within the Service for paid interactions such as gifting outfits or food. Soul stones cannot be exchanged for cash.
• Account: The user-identifying information created by signing in with a Google account, together with all fairy data linked to it.

Article 3 (Effect and Amendment of These Terms)

• These Terms take effect once posted within the Service or on the website.
• We may amend these Terms to the extent permitted by applicable law. Amendments are announced at least 7 days in advance (30 days for changes unfavorable to users), stating the effective date and reason for the change.
• If you do not agree to amended Terms, you may stop using the Service and delete your account. Continued use of the Service after an amendment takes effect constitutes acceptance of the amended Terms.

Article 4 (Formation of the Usage Agreement)

• The usage agreement is formed when you install the extension from the Chrome Web Store and complete "adoption" of a fairy. No personal information is transmitted to our servers before this point.
• Account-based features — cloud sync, conversation, image recognition, and similar — are only available after signing in with a Google account.

Article 5 (Provision and Modification of the Service)

• We provide conversation with your fairy, image-recognition interactions, long-term memory, voice output, and related features.
• We may modify the content of the Service for operational or technical reasons, and will give advance notice of material changes.
• The Service generates responses using generative AI models and does not guarantee the accuracy or completeness of those responses. Your fairy's dialogue is generated content for entertainment purposes — not factual information or professional advice.

Article 6 (Hours of Availability)

The Service is intended to be available 24/7, but may be temporarily suspended for system maintenance, server outages, or reasons required by applicable law.

Article 7 (Soul Stones and Paid Subscription Services)

• A number of soul stones are granted free of charge upon adoption, with 1 additional stone recharging automatically every day, or additional stones grantable each month via the website's monthly subscription plans (BASIC, PLUS).
• Paid subscriptions are billed automatically every month through Creem, our international payment provider and Merchant of Record. Payment method, billing date, amount, and other details are disclosed on-screen at checkout and in confirmation emails. Because payments are processed internationally, VAT or other applicable taxes may be collected by Creem as part of the charged amount.
• A subscription renews automatically each month until canceled by the user; cancellation procedures and refund conditions are set out in Article 8 and in our Refund & Cancellation Policy.
• Soul stones may only be used for interactions designated within the Service, such as gifting outfits or food, and cannot be exchanged or transferred for cash or goods.
• Soul stones do not expire, but any remaining balance is forfeited upon account deletion.

Article 8 (Subscription Cancellation and Refund Policy)

• You may cancel your subscription at any time; cancellation stops automatic billing starting from the next billing cycle. Charges already billed, and soul stones already granted as a result, are not retroactively reversed by cancellation.
• You may request a refund for purchased soul stones within the withdrawal period and under the conditions set out by applicable consumer protection law. Refunds may be limited to the extent that purchased soul stones have already been used.
• Detailed cancellation and refund procedures and conditions are set out in our Refund & Cancellation Policy.
• Refund requests should be sent to newmadlog@gmail.com and will be processed within the period required by applicable law.
• If your access is restricted due to a violation of these Terms, refunds may be limited or subject to a deduction.

Article 9 (User Obligations)

Users must not engage in any of the following:

• Using another person's Google account without authorization
• Intentionally submitting inappropriate content (sexual, violent, or unlawful images or conversation) to the Service
• Interfering with the normal operation of the Service, or using automated tools to manipulate the soul stone or stamina systems
• Reverse-engineering the Service or copying or distributing its source code without authorization
• Any other act that violates applicable law or these Terms

We may restrict access to the Service or suspend an account without prior notice if a user violates any of the above.

Article 10 (Our Obligations)

• We will not engage in conduct prohibited by applicable law or these Terms, and will work to provide a stable, continuous service.
• We protect user personal information in accordance with our Privacy Policy.

Article 11 (Termination and Restriction of Use)

• You may terminate the usage agreement at any time by signing out and requesting account deletion from the popup.
• Upon termination, your soul stone balance and fairy data are forfeited and deleted immediately, except for information we are required to retain by law.

Article 12 (Disclaimer)

• We are not liable for service interruptions arising from events beyond our control, such as natural disasters or system failures not caused by our intent or negligence.
• We do not warrant the accuracy or reliability of any content generated by your fairy (AI), and are not liable for damages arising from reliance on such content.
• We have no obligation to intervene in disputes between users, or between a user and a third party, arising in connection with the Service, and are not liable for any resulting damages.

Article 13 (Dispute Resolution and Governing Law)

• These Terms are governed by and construed in accordance with the laws of the Republic of Korea.
• Any dispute between the Service and a user arising from use of the Service may be brought before a court of competent jurisdiction under the applicable rules of civil procedure.

These Terms are effective as of August 28, 2026.
